Under Section 213A of the Immigration and Nationality Act (INA), most family-based green card sponsors must demonstrate an annual income at or above 125% of the Federal Poverty Guidelines for their household size.

Household size generally includes the sponsor, the sponsor's spouse, qualifying children, other tax dependents, immigrants being sponsored on the current Form I-864, and immigrants previously sponsored under Form I-864 whose support obligations have not ended. Certain relatives living with the sponsor may also be included when their income is being used through Form I-864A. Each person is counted only once.

If the intending immigrant is the spouse or a U.S.-citizen sponsor's child who is age 18 or older, qualifying assets generally must equal at least 3 times the applicable income shortfall. In most other cases, the multiplier is 5 times. A separate 1-times rule applies to certain qualifying orphans who will acquire U.S. citizenship after admission.

A sponsor on active duty in the U.S. Armed Forces, other than active duty for training, generally may use the 100% Federal Poverty Guidelines level when sponsoring the sponsor's spouse or unmarried child under 21. Other beneficiaries remain subject to the applicable 125% requirement.

If the petitioner does not meet the income requirement, a qualifying joint sponsor may file a separate Form I-864. The joint sponsor must be at least 18, be a U.S. citizen, U.S. national, or lawful permanent resident, be domiciled in the United States or its territories or possessions, and independently meet the applicable income or asset requirement for the intending immigrant(s) covered by the joint sponsor's affidavit.

The Form I-864 support obligation generally ends when the sponsored immigrant becomes a U.S. citizen, can be credited with 40 qualifying quarters of coverage, ceases to hold lawful permanent resident status and departs the United States, receives a new qualifying adjustment of status in removal proceedings, or dies. The sponsor's own obligation also ends upon the sponsor's death, although previously accrued reimbursement obligations are not erased.
