Canada Visa & Immigration Rules

Demystifying complex Immigration, Refugees and Citizenship Canada (IRCC) policies. Step-by-step compliance guides for skilled workers, families, and students.

Core Canadian Immigration Systems

The Primary PR Pathway

Express Entry is a points-based application management system for three federal economic programs: the Canadian Experience Class (CEC), the Federal Skilled Worker Program (FSWP), and the Federal Skilled Trades Program (FSTP).

Express Entry Pillars:
  • 1. Pool Entry: Candidates submit a profile and receive a score out of 1,200 points based on the Comprehensive Ranking System (CRS).
  • 2. Regular Draws: IRCC issues Invitations to Apply (ITAs) to the highest-scoring candidates.
  • 3. Category-Based Draws: Rather than overall rank, draws target specific high-demand fields: French Language, STEM, Healthcare, Trades, Transport, and Agriculture.

Targeted Provincial Nomination

Canada’s provinces and territories run their own immigration streams to meet local economic and population needs. Receiving a Provincial Nomination grants an automatic 600-point boost to your Express Entry profile, virtually guaranteeing an ITA.

Some provinces operate independently of Express Entry (non-Express Entry PNP) which requires a physical, paper-based application process and has different timelines.

  • Ontario (OINP): Target streams for master's grads, international students, and tech professionals.
  • British Columbia (BC PNP): Focuses on tech occupations and healthcare professions.
  • Saskatchewan (SINP): Uses a strict 110-point grid focusing on high-demand work experience.

Maintaining Legal Status

Most expats arrive in Canada as temporary workers or international students. Maintaining status, changing employers, and securing open work permits are critical hurdles.

Critical Rules for Workers & Students:
  • PGWP Rules: Post-Graduation Work Permits require full-time status, specific program areas, and minimum language test scores (CLB 5 for college, CLB 7 for university).
  • Spousal OWP: Spousal Open Work Permits are restricted to spouses of students in master's or doctoral programs, or spouses of high-skilled TEER 0/1/2/3 workers.
  • Maintained Status: If you apply online to extend your permit before it expires, you can continue working/studying under the same conditions until a decision is made, provided you do not leave Canada.

Reuniting Families in Canada

Canadian citizens and Permanent Residents can sponsor their spouses, common-law partners, conjugal partners, dependent children, and parents to obtain Permanent Residency.

  • Undertaking Period: Sponsors sign a legal contract to financially support their sponsored relative. This period is 3 years for spouses/partners and 10 years for dependent children.
  • No Income Minimum for Spouses: Unlike parental sponsorship, there is no Minimum Necessary Income (MNI) threshold to sponsor a spouse or child, unless the child has dependent children of their own.

PR to Citizenship Requirements

Permanent Residents can apply for Canadian citizenship once they fulfill the strict residency obligations and pass the official civics examination.

  • Physical Presence: You must be physically present in Canada for at least 1,095 days out of the 5 years immediately preceding your application.
  • Temporary Resident Credit: Days spent in Canada as a visitor, student, or worker before becoming a PR count as half-days, up to a maximum credit of 365 days.
  • Citizenship Exam: Applicants aged 18 to 54 must take a 20-question multiple-choice exam on Canadian history, geography, values, and governance. A passing score of 15/20 is required.
