Under Article 51 of UAE Labor Law (Federal Decree-Law No. 33 of 2021), gratuity is calculated based on the employee's last basic monthly salary: 21 days basic salary per year for the first 5 years, and 30 days basic salary per year for subsequent years.
Gratuity is calculated strictly using your last basic monthly salary. Fixed allowances (housing, transport, utilities) and variable bonuses are excluded from the calculation.
The total end-of-service gratuity payout cannot exceed two years' (24 months) total basic salary of the employee under MoHRE regulations.
No. Employees who resign or are terminated before completing 1 full year (12 continuous months) of service are not entitled to any End of Service Gratuity payout under Article 51.
After completing 1 full year of service, employees are entitled to pro-rata gratuity for any additional fraction of a year worked, calculated based on the exact number of days served.
Yes. Under Article 51, employers may deduct lawful company loans, salary advances, or court-ordered attachments from the employee's final end-of-service settlement.
