Australian Migration Architecture: Statutory Framework & 2026 Reforms

Department of Home Affairs (DHA) & Migration Act 1958 Standards

Australia's immigration system is governed by the Migration Act 1958 and managed by the Department of Home Affairs (DHA). Anchored by the comprehensive multi-year Migration Strategy, the national intake prioritizes targeted skilled migration to alleviate regional workforce shortages while closing integrity loopholes in international education. The primary economic pathway is the General Skilled Migration (GSM) program, which invites skilled professionals via the online SkillSelect portal across Subclasses 189 (Independent), 190 (State Nominated), and 491 (Regional Provisional).

For employer-sponsored professionals, the Temporary Skilled Migration Income Threshold (TSMIT) mandates a minimum base salary floor of AUD $73,150, guaranteeing market-rate remuneration and providing a streamlined 2-year transition to permanent residency under the Subclass 186 Employer Nomination Scheme (ENS). International graduates navigating post-study work rights face reformed Subclass 485 provisions with a maximum age cap of 35 years and heightened English benchmarks (IELTS 6.5 minimum).

Frequently Asked Questions: Australia Migration & Visas

Department of Home Affairs Policies, SkillSelect Points, and Permanent Residency

Australia's General Skilled Migration program operates through the SkillSelect online expression of interest (EOI) platform. Candidates must score at least 65 points on the statutory points test (awarded for age, English language ability, overseas and Australian skilled employment, educational qualifications, specialist research degrees, and partner skills) to lodge an EOI. Points invitations are issued through competitive invitation rounds for the Subclass 189 (Skilled Independent), Subclass 190 (Skilled Nominated), and Subclass 491 (Skilled Work Regional) visas.

Under the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (Subclass 186), temporary skilled workers who have worked full-time for their nominating employer for at least 2 years on a Subclass 482 visa can be nominated for direct Permanent Residency. Nominations are open across all occupations on the Core Skills Occupation List (CSOL) provided the employer meets statutory sponsorship obligations and the applicant earns at or above the TSMIT threshold.

Generally, temporary visa holders are not covered by Australia's national Medicare scheme and must maintain private Overseas Student Health Cover (OSHC) or Overseas Visitor Health Cover (OVHC). However, important statutory exceptions apply: (1) Citizens of countries with Reciprocal Health Care Agreements (RHCA) such as the UK, Ireland, Italy, and New Zealand; (2) Subclass 491 and Subclass 494 regional visa holders; and (3) Applicants who have lodged a valid onshore application for a permanent visa (such as a Partner Visa Subclass 820) and hold a valid Bridging Visa with work rights.

When temporary residents work in Australia, employers are required by law to contribute at least 11.5% (rising to 12%) of ordinary time earnings into an Australian superannuation retirement fund. Upon leaving Australia permanently after their temporary visa expires or is cancelled, eligible departing residents can apply to the Australian Taxation Office (ATO) for a Departing Australia Superannuation Payment (DASP) to withdraw their accumulated super funds, subject to statutory withholding tax rates (typically 35% for standard temporary visas and 65% for Working Holiday Makers).
