Two Pathways to H-4 EAD Eligibility
To qualify for an H-4 EAD card under category (c)(26), your principal H-1B spouse must meet at least one of the following statutory requirements:

2026 EAD Renewal & Automatic Extension Rules
Important 2026 Rule:
- The former general 540-day automatic extension does not generally apply to new C26 renewal applications filed on or after October 30, 2025.
- Earlier qualifying C26 renewal applications can remain protected under the prior automatic-extension rules, subject to the applicable requirements.
- Do not rely on a pending C26 renewal filed on or after October 30, 2025 as employment authorization after the current EAD expires.

Concurrent Processing: A qualifying H-4 Form I-539 filed together with the principal H-1B Form I-129 can be handled in conjunction with the principal petition under USCIS premium-processing procedures. For category (c)(26) H-4 EAD renewal applications filed on or after October 30, 2025, the prior general 540-day automatic extension does not apply. Not generally for new C26 renewal applications filed on or after October 30, 2025. DHS ended the general automatic EAD-extension rule for those newly filed renewal applications. A qualifying C26 renewal filed before October 30, 2025 can remain subject to the prior automatic-extension rules, subject to the applicable requirements and limits.

A valid H-4 EAD generally provides broad employment authorization that is not tied to one sponsoring employer. The holder can generally work for different U.S. employers and may engage in self-employment or business activity while the EAD is valid and the underlying H-4 eligibility is maintained.
Required documents include Form I-765, copy of principal H-1B spouse's approved Form I-140 notice (I-797), copy of H-4 spouse's I-94 arrival record, copy of marriage certificate, 2 passport photos, and Form I-765 filing fee.
