Spain's long-term residence system has two distinct forms: national long-term residence (Residencia de Larga Duración) and long-term residence-EU (Residencia de Larga Duración-UE). National Larga Duración authorizes a qualifying third-country national to reside and work in Spain indefinitely under the same conditions as Spanish nationals. The ordinary route is based on five years of legal and continuous temporary residence in Spain, subject to the statutory absence rules. Larga Duración-UE is a separate status under the EU long-term resident framework and adds requirements concerning fixed and regular financial resources and health insurance, while also providing a framework that can facilitate residence in other EU Member States subject to their national conditions. The physical TIE is not itself permanent: the immigration status is indefinite, while the card has to be renewed periodically.

National Larga Duración vs. Larga Duración-UE

Residencia de Larga Duración

Legal Basis: Article 32 of Organic Law 4/2000 and Articles 182 to 185 of RD 1155/2024.

Authorizes the holder to reside and work in Spain indefinitely under the same conditions as Spanish nationals.

Five years of legal and continuous temporary residence in Spain immediately before the application, subject to the legal continuity and absence rules.
Residencia de Larga Duración-UE

Legal Basis: Articles 175 to 178 of RD 1155/2024 together with the EU long-term resident framework.

Provides long-term residence in Spain and a legal framework that can facilitate residence in another EU Member State under that state's immigration conditions.

Unlike national Larga Duración, the EU form requires fixed and regular resources sufficient for the applicant and family where applicable, together with qualifying public or private health insurance.

5-Year Continuity & Statutory Absence Limits

National Route Absences:

The ordinary national route requires five years of legal and continuous temporary residence in Spain immediately before the application.

Continuity is not affected by absences of up to six consecutive months provided the total does not exceed ten months during the five-year qualifying period, except where the relevant exits were irregular.
Where the absences are for work reasons, continuity can be maintained with up to six consecutive months at a time provided the total does not exceed eighteen months during the required five years.
EU Route & Student Time Credit:

For the Spain-based Larga Duración-UE route, the Ministry likewise uses five years of legal and continuous residence in Spain with the same six-month/ten-month framework, or the eighteen-month total where the absences are for work.

For the five-year Larga Duración-UE calculation, periods in study stay, student mobility, volunteering or training count at 50% of their duration, provided that at the time of application the foreign national is in a residence situation in Spain.
A qualifying EU Blue Card holder can also qualify through the special EU-wide route by accumulating the required five years of legal and uninterrupted residence in the EU in the specified qualifying statuses and having resided legally and continuously in Spain for the immediately preceding two years as an EU Blue Card holder.

Additional Eligibility & Financial Resources

General Admissibility Criteria:
  • The applicant must not be a citizen of the EU, EEA or Switzerland for the ordinary third-country-national long-term routes.
  • The applicant must not have the relevant criminal records in Spain or in the countries where they have resided during the previous five years for offenses recognized under Spanish law.
  • The applicant must not constitute a threat to public order, public security or public health.
  • The applicant must not be listed as inadmissible under the applicable international arrangements with Spain.
  • The applicant must not be within an applicable commitment period not to return to Spain where such a restriction applies.
EU Resource Thresholds:

Larga Duración-UE additionally requires fixed and regular financial resources sufficient for the applicant and family members who depend on the applicant.

Benchmark: The Ministry's current guidance sets a resource benchmark of 150% of IPREM for a two-member family unit and an additional 50% of IPREM for each additional family member.

Healthcare: The applicant must also have public or private health insurance contracted with an insurer authorized to operate in Spain.

Statutory Special Cases: National Larga Duración can also be available in specified statutory situations beyond the ordinary five-year route, including certain persons who receive qualifying long-term social-security or pension benefits, stateless persons, refugees or beneficiaries of subsidiary protection, and persons whose contribution to Spain's economic, scientific or cultural progress is formally recognized.

National Larga Duración Rights:

Larga Duración-UE Framework Rights:
  • Long-term residence in Spain.
  • Potential mobility to another EU Member State under the EU long-term resident framework.
  • A legal basis for applying for residence in another participating Member State for employment, studies, training or other qualifying purposes, subject to that state's rules.
Critical Legal Boundaries:
  • Long-term residence does not make the holder a Spanish citizen.
  • Larga Duración-UE does not automatically confer residence in another EU country.
  • The TIE expiry does not ordinarily mean the underlying national long-term residence itself has expired; the card and the underlying status are distinct.

TIE Card Renewal & Extinction Rules

Indefinite Status Principle: National Larga Duración is indefinite, so the underlying authorization is not renewed like an ordinary temporary residence permit. The physical TIE is renewed separately.

TIE Card Renewal Schedule:

First Renewal: The current Ministry guidance states that the first TIE renewal for national long-term residence is requested after five years.

Subsequent Renewals: Under the current national long-term residence guidance, later TIE renewals are requested every five years until the holder reaches 30 years of age and every ten years after that.

Renewal Window: The TIE renewal application should normally be submitted during the two months immediately before the card expires. A late application made within the following three months also extends the previous card until the decision, without removing possible sanction consequences.

EU Blue Card Exception: For persons whose Larga Duración-UE status was obtained after qualifying EU Blue Card residence, the EU-absence period in the relevant extinction rule can be extended to 24 consecutive months.
