Under 8 CFR § 106.4, when USCIS issues a Request for Evidence (RFE) on an H-1B petition filed with Premium Processing (Form I-907):
- The clock stops: USCIS's Premium Processing timeframe stops when it issues an RFE.
- The clock resets: When USCIS receives the RFE response, a new 15-business-day timeframe begins for an H-1B petition.

The Asylum Program Fee is $600 for regular petitioners, $300 for qualifying small employers with 25 or fewer full-time equivalent employees, and $0 for qualifying nonprofit petitioners. It generally applies to Form I-129 filings, including initial petitions and extensions, unless an applicable exemption applies.
USCIS processes fees into separate Treasury accounts. If fees are bundled into a single check and one fee calculation is incorrect, USCIS rejects the ENTIRE petition package. Writing separate checks prevents blanket rejections.
An additional $4,000 fee can apply when the petitioner employs 50 or more people in the United States, more than 50% of those employees are in H-1B, L-1A, or L-1B status, and the petitioner is required to pay the H-1B Fraud Prevention and Detection fee. The statutory fee does not apply to every H-1B filing and has specific exceptions.
For an H-1B Form I-129 petition, the current Form I-907 Premium Processing fee is $2,805. USCIS provides a 15-business-day premium-processing timeframe for H-1B petitions, measured in federal business days rather than calendar days.
When USCIS issues an RFE or qualifying notice, the Premium Processing timeframe stops. When USCIS receives the response, a new applicable Premium Processing timeframe begins from Day 1. For an H-1B petition, the applicable timeframe is 15 federal business days. USCIS does not guarantee approval within a particular number of days after an RFE response; the guaranteed action is an approval, denial, request for evidence, or other permitted adjudicative action within the applicable timeframe.
