  • 💡 On-Campus, CPT, & OPT: The exemption applies only to wages earned under approved student employment. It does not apply if you change status to an H-1B, L-1, or TN visa.

What is the deadline for claiming an IRS FICA refund?

Generally, you must file Form 843 to claim a refund within 3 years from the date you filed your original return or 2 years from the date you paid the tax, whichever is later.

What should I do if my employer refuses to issue a refund?

If your employer refuses or is unresponsive, you must document this refusal. You can then file Form 843 and Form 8316 directly with the IRS. In Form 8316, you will explicitly state that you contacted your employer and they declined to refund the taxes.

Are J-1 visa holders also exempt from FICA taxes?

Yes. Under the same IRC Section 3121(b)(19) exemption, J-1 students, scholars, and researchers who are nonresident aliens are exempt from Social Security and Medicare taxes. The exemption is limited to 2 calendar years for J-1 scholars/researchers, and 5 calendar years for J-1 students.
