UAE Federal Supreme Court & Judicial Hierarchy Guide
Understand the federal judiciary, local emirate courts, Federal Supreme Court jurisdiction, Court of Cassation, appeal deadlines and the difference between mainland and specialist financial-free-zone courts.
Important: The UAE does not have one single court hierarchy covering every dispute in all seven emirates. The correct court depends on jurisdiction, emirate, subject matter and the governing procedural framework.
The first question is jurisdiction
The UAE Constitution establishes both a federal judiciary and local judicial authorities in the emirates. Article 104 provides that local judicial authorities retain matters not assigned to the UAE courts, while Article 105 permits certain local jurisdiction to be transferred to federal courts by federal law at the request of the emirate.
The UAE Government currently identifies independent local judicial departments in Abu Dhabi, Dubai and Ras Al Khaimah. It also states that Sharjah, Ajman, Fujairah and Umm Al Quwain follow the federal judicial system.

Federal Judicial System
The current federal judicial structure consists of Federal Courts of First Instance, Federal Courts of Appeal and the Federal Supreme Court. Federal jurisdiction applies to matters assigned to the federal judiciary by the Constitution and federal laws.

The following figures are federal-law benchmarks and must not automatically be substituted for a local or specialist jurisdiction deadline.
Federal civil / commercial appeal benchmark
30 days is the general appeal period under Article 161 of the current federal Civil Procedure Code.
Special rule: Summary proceedings have a 10-day appeal period unless another law provides otherwise.

These are statutory federal-law benchmarks, not a guarantee that every judgment has exactly the same deadline. Service, judgment type, procedural route and special legislation can affect how the time period operates.
Federal court hierarchy
Federal Court of First Instance
Federal first-instance courts hear matters falling within federal jurisdiction. The Federal Judicial Authority law provides specialised circuits for criminal, civil and commercial, administrative, personal-status and other matters.
Federal Court of Appeal
Federal appellate courts hear appealable judgments from federal first-instance courts under the applicable legislation. Current federal judicial-organization law provides federal Courts of Appeal and specialised appellate circuits.
Federal Supreme Court
The Federal Supreme Court is the highest court in the federal judiciary. Its constitutional jurisdiction under Article 99 is broader than ordinary final-error review and includes constitutional, federal-state and jurisdictional matters.

What does the Federal Supreme Court actually hear?
Article 99 of the Constitution gives the Federal Supreme Court defined federal and constitutional jurisdiction. Its role is not simply “the third level of every lawsuit in the UAE.”
Federal / emirate disputes
Disputes between member emirates, or between one or more emirates and the federal government, when constitutionally referred to the Court.
Constitutional review
Review of the constitutionality of federal laws and specified emirate legislation under Article 99.
Constitutional interpretation
Binding interpretation of constitutional provisions when properly requested by a federal authority or emirate government.
Jurisdiction conflicts
Conflicts between federal and local courts and, under Article 99, conflicts between courts in different emirates.
Court of Cassation vs Federal Supreme Court

“Supreme Court” and “Court of Cassation” should therefore never be used interchangeably when explaining UAE judicial hierarchy.
Court language and hearings
Language
Article 25 of the Federal Judicial Authority law states that Arabic is the language of the courts. Statements of litigants or witnesses who do not speak Arabic are heard through an interpreter under the applicable oath and procedural rules.
Public hearings
Article 26 states that federal court hearings are public unless the law or the court provides for a closed hearing to preserve public order, public morals or the sanctity of private life. Judgments are pronounced publicly.
DIFC and ADGM: specialist financial-free-zone courts
DIFC Courts and ADGM Courts should not be inserted into the ordinary mainland federal/local hierarchy. They are specialist courts created under the legal frameworks of the respective financial free zones.
DIFC Courts
A common-law based specialist court system using English prominently in proceedings and operating under the DIFC legal framework.
ADGM Courts
A specialist court system within Abu Dhabi Global Market, operating under the ADGM legal framework and using English in its proceedings.
