STEM OPT Frequently Asked Questions

Can I continue to work while my STEM OPT application is pending?

Yes. Under federal regulation 8 CFR 274a.12(c)(6)(iv), if you timely file your STEM OPT extension application (Form I-765) before your initial 12-month OPT EAD expires, your employment authorization is automatically extended for up to 180 days while your application is pending.

What is the automatic H-1B Cap-Gap extension?

If your employer files a timely cap-subject H-1B petition requesting a Change of Status on your behalf, and your OPT/STEM OPT expires before October 1, the Cap-Gap extension automatically extends your status and work permission until April 1st of the following year.
