Statutory Framework & Tax Savings

An Individual Taxpayer Identification Number (ITIN) is issued under 26 U.S.C. ยง 6109 strictly for tax processing. An ITIN does not authorize work in the US, nor does it alter immigration status.

For some visa families, such as an H-1B worker who has a nonresident-alien H-4 spouse, an ITIN may be needed for the spouse to file a joint federal return when the applicable requirements are met. Under IRC Section 6013(g), a U.S. citizen or resident alien spouse may elect to treat a nonresident-alien spouse as a U.S. resident for federal income-tax purposes, subject to the statutory requirements and election rules. Filing jointly may produce a tax benefit, but the actual result depends on the family's facts.

Who Can Qualify for an ITIN?

An ITIN is available only when there is a qualifying federal tax purpose. Spouses and dependents generally must be claimed for an allowable tax benefit or file their own federal tax return. Examples of allowable tax benefits include Married Filing Jointly, certain head-of-household or qualifying-surviving-spouse situations, the American Opportunity Tax Credit, Premium Tax Credit, Child and Dependent Care Credit, and Credit for Other Dependents.

How to Apply for an ITIN

  1. Complete the current Form W-7 and select the reason that accurately matches the applicant's circumstances.
  2. Prepare the required identity, foreign-status, and, where applicable, U.S.-residency documentation.
  3. Attach the W-7 to the applicable federal income-tax return unless the applicant qualifies for a Form W-7 exception.
  4. Submit the package by mail, through an IRS Taxpayer Assistance Center that provides ITIN services, or through an IRS Certified Acceptance Agent.
  5. Keep copies of the application and supporting documentation for your records.

Important Dependent Documentation Rule

A passport without a U.S. entry date may not be sufficient by itself for certain dependent applicants because the IRS may require separate proof of U.S. residency. The exact documentation depends on the dependent's age, country of residence, military status, and the allowable tax benefit being claimed.

ITIN Does Not Create Work Authorization

An ITIN is issued for federal tax purposes only. It does not authorize employment, provide Social Security benefits, or change a person's immigration status.

Frequently Asked Questions (FAQ)

An ITIN is a 9-digit tax processing number issued by the IRS under 26 U.S.C. Section 6109 to individuals who need a U.S. taxpayer identification number for federal tax purposes but are not eligible for a Social Security number (SSN). An ITIN is for federal tax purposes only and does not authorize employment, provide Social Security benefits, or change immigration status.

An H-4 or L-2 spouse who is not eligible for an SSN may need an ITIN when the spouse is eligible for an allowable tax benefit or must file a U.S. federal tax return. A U.S. citizen or resident-alien spouse may, in appropriate circumstances, elect under IRC Section 6013(g) to treat a nonresident-alien spouse as a U.S. resident for federal income-tax purposes and file a joint return. For tax year 2026, the standard deduction for Married Filing Jointly is $32,200, but the actual tax benefit of filing jointly depends on both spouses' income, deductions, credits, and other facts.

For a spouse of a U.S. citizen or resident alien who is applying under the spouse category, Form W-7 uses Box e ('Spouse of U.S. citizen/resident alien'). Dependent applicants may qualify under the applicable dependent/allowable-tax-benefit category, but the correct reason depends on the applicant's facts and the tax benefit or filing purpose.

The IRS requires documentation establishing identity and foreign status. A current foreign passport is generally the only standalone document that establishes both. If a passport is not submitted, the IRS generally requires a combination of other acceptable documents, with at least one containing a photograph. The IRS accepts original documents or certified copies from the issuing agency, and applicants can use an IRS Taxpayer Assistance Center or Certified Acceptance Agent (CAA) for document authentication. Special rules apply to certain applicants, including some dependents and U.S. military dependents.

Under the PATH Act rules, an ITIN expires on December 31 of the third consecutive tax year if it was not included on at least one U.S. federal income-tax return during the last three consecutive tax years. An expired ITIN must be renewed before it can be used again on a federal tax return.

For tax year 2026, the standard deduction for Married Filing Jointly is $32,200, compared with $16,100 for Married Filing Separately. Joint filing also uses wider married-filing-jointly tax brackets, but the actual tax savings vary substantially based on both spouses' income, deductions, credits, residency status, and other facts. A specific dollar savings estimate cannot be determined from household income alone.
