E-3 Visa Qualification Checklist
Check off the core requirements to verify your readiness for the application:
You must hold an Australian passport. Permanent residents are not eligible for E-3 status.
A standard 4-year degree (or 3-year Australian degree with academic evaluation, or 12 years of professional experience).
A legitimate job offer from a U.S. employer in a role requiring theoretical and practical application of highly specialized knowledge.
The U.S. employer must secure a certified Form ETA-9035 from the Department of Labor committing to pay prevailing wages.
Automatic E-3S Spousal Work Authorization
A major advantage of the E-3 visa program is the spousal work authorization rule:
- Work Incident to Status: Spouses of E-3 holders (admitted under code E-3S on their Form I-94) are legally authorized to work automatically from their day of entry. They do not need to apply for an Employment Authorization Document (EAD) card.
- Form I-9 Compliance: An unexpired Form I-94 reflecting the "E-3S" designation serves as a valid List C document for U.S. employment verification.
- Dependent Children Exception: Children of E-3 visa holders are admitted under code E-3D (or E-3Y) and are not authorized to work in the United States.
Extensions and Consular Renewals
E-3 status is granted for a maximum of 2 years per petition. There is no statutory limit on the number of times you can renew, allowing for indefinite extensions:
