Article 21(2) is an income-tax treaty benefit for eligible Indian students/business apprentices, while the F-1 FICA exemption is a statutory Social Security/Medicare rule. For the federal substantial presence test, an eligible F-1 student is generally treated as an exempt individual for up to 5 calendar years, provided the student substantially complies with the F-1 requirements. Those excluded days are not counted toward the substantial presence test. Tax filing status still depends on the applicable federal rules.

A nonresident-alien F-1 student is generally exempt from Social Security and Medicare taxes on authorized employment performed to carry out the purpose for which the student was admitted, including qualifying on-campus employment and authorized CPT/OPT. The exemption generally applies during the student's first 5 calendar years under the federal residency rules, but it does not apply to unauthorized or unrelated employment or after the student becomes a resident alien. This is a statutory FICA rule, not a tax-treaty benefit.

Generally yes, when the F-1 student is excluding days of U.S. presence from the substantial presence test. Form 8843 explains the basis for excluding those days and is required even when the student had no U.S. income. Qualifying F-2 dependents generally file their own Form 8843 as well. The deadline depends on whether the form is attached to a required tax return or filed as a standalone Form 8843.

An eligible Indian student or business apprentice claims the standard deduction directly on Form 1040-NR, line 12, using the standard-deduction amount for the applicable filing status. The current IRS Form 1040-NR instructions contain an exception from Form 8833 disclosure for certain treaty claims involving students, trainees, teachers, and other specified income categories, so Form 8833 is not automatically required for an Article 21(2) student standard-deduction claim.

First request a refund from the employer or payroll office. If the employer cannot provide the full refund, the student can file Form 843 and, when applicable, Form 8316 with the IRS and the required supporting documentation, including evidence of the erroneous withholding and immigration/employment status. The refund is for Social Security and Medicare taxes that were erroneously withheld.

For a calendar-year nonresident alien who received wages subject to U.S. income-tax withholding and must file Form 1040-NR, the normal federal due date is April 15. If the nonresident alien did not receive wages subject to withholding and has a Form 1040-NR filing requirement, the normal due date is June 15. Form 8843 attached to Form 1040-NR follows the return's deadline; a standalone Form 8843 generally uses the applicable nonresident filing deadline.
