🇬🇧 Power of Attorney for the United Kingdom
To manage property sales, banking transactions, or probate in the UK while residing in the U.S., you can draft a General (Ordinary) Power of Attorney or a Lasting Power of Attorney (LPA).
Core Steps to Execute:
- Drafting: The document must follow English & Welsh, Scottish, or Northern Irish legal terminology.
- Notarization: Sign the POA in front of a licensed U.S. notary public.
- Apostille: Because the U.S. and the UK are both members of the Hague Apostille Convention, you must obtain an Apostille certification from the Secretary of State where the notary is commissioned. Consular legalization is not required.
- Registration: Lasting Power of Attorney (LPA) documents must be registered with the Office of the Public Guardian (OPG) in the UK before they can be used.
⚠️ Caution: Ensure the notary uses an block certificate that conforms to state laws so the Secretary of State does not reject the apostille request.
Apostille Details
Hague Apostille: All four countries (UK, Canada, China, France) are members of the Hague Apostille Convention. This means a standard Apostille from your U.S. state's Secretary of State office makes the notarized document legally binding in these countries without consulate involvement.
